Leach’s lawyers fire back against Tech

Team Leach — his legal team, not the ever-growing Facebook group — took its game to the next level Tuesday.

Attorneys for fired Texas Tech football coach Mike Leach filed a sharp legal rebuttal to claims by university administrators that Leach was responsible for his own termination.

In a third set of amendments to its Dec. 30 legal petition against Leach’s firing, filed in a Lubbock County court, the legal team has expanded its grounds for the lawsuit and is claiming Leach’s firing was based on factors extending beyond the football field and his alleged mistreatment of an injured player.

Among them is their belief Leach was fired for filing a temporary restraining order against the university the day after his indefinite suspension on Dec. 28.

“To me, that’s just flat wrong, for a university or any state agency in this state, to take an action and terminate an employee for simply exercising his rights given to him — not only by the constitution but by contract,” Paul Dobrowski, a member of Leach’s legal team, said during a Tuesday news conference. “We’re not going to stand for it.”

They expect to ask for “substantial” monetary damages.

Leach wrote, in a statement released Tuesday, “Obviously, I did not want to be suspended or terminated as head football coach at Texas Tech University. I categorically deny that I mistreated Adam James, refused to cooperate with the school’s investigation, or acted in an insubordinate manner as an employee of the university.”

Attorneys representing the university issued a statement Tuesday insisting the school fired Leach not because of his legal response but because of his treatment of an injured football player and for insubordination.

“We have reviewed the … petition filed by Coach Leach’s legal counsel and it contains numerous falsehoods and gross inaccuracies,” wrote Dicky Grigg, an attorney for the university. “Our position will be set forth through the litigation process.”

A hearing on Leach’s motion to expedite the legal proceedings, filed last week, is scheduled for 10 a.m. on Jan. 20. Leach’s attorneys have asked for a trial date no later than March 1, but Dobrowski said he’s not banking on that and would abide by whatever the judge rules.

“We’re asking that the order be moved up and get this done quickly because, look, the fact is coach Leach is unemployable,” Dobrowski said. “The longer this hangs over his head, the more opportunities he’s going to miss.”

Leach’s lawyers are seeking redress on seven grounds, including defamation, breach of contract, and violations of his due process rights.

Question of ’sovereign immunity’
Tech on Tuesday filed a motion to dismiss the case on the grounds of “sovereign immunity,” which means a state agency or entity cannot be sued without its permission, but Leach’s attorneys are requesting the court deny that defense.

Such immunity does not apply to Leach’s case, his attorneys say. They invoked the Texas Whistleblower Act, which gives legal recourse to aggrieved employees, and said Tech’s conduct in the matter waives the university’s immunity.

“We anticipate that when that matter is decided by Judge (Bill) Sowder, he’ll consider all of those items,” Dobrowski said. “And we expect that our position will be vindicated.”

‘Coach Leach has been … harmed’
Dobrowski said one purpose of the litigation is to vindicate Leach so he can restore his reputation and pursue a job with another college football program.

“I think it’s obvious to everyone that coach Leach has been materially harmed in terms of his reputation and in terms of his ability to make a living,” Dobrowski said. “The man has a wife and kids, and having listened to some of the ESPN and other talk shows, he’s been called radioactive. No other Division I university, and no other athletic department, is going to touch coach Leach while these, frankly, unfounded and wrongful allegations are out there.”

Dobrowski said Leach also is seeking monetary damages, an amount he couldn’t quantify but called “substantial.” Leach was fired after the first year of a five-year, $12.7 million contract with the university.

“The rest of the contract, absolutely, because (Texas Tech), frankly, didn’t follow the contract procedures and they breached the contract,” Dobrowski said. “And we believe that affords him all remedies from the entire term of the contract.”

When asked if there has been any communication with Tech regarding an out-of-court settlement, Dobrowski said, “None.” But he also said the Leach camp would be willing to consider a settlement proposal.

Suit against James family?
Dobrowski also did not rule out the possibility of a separate civil suit against Adam James’ family, including ESPN college football analyst Craig James.

“That is not something that we have pursued at this point in time,” he said. “Certainly, that is something that coach Leach will have to consider.”

Other reasons
Regarding the legal battle against Tech, Leach’s attorneys presented several arguments to buttress their claims Leach was fired not just for his treatment of the player.

At one point during the investigation into Leach’s treatment of Adam James, according to the court filings, Tech President Guy Bailey worried Chancellor Kent Hance was trying to “railroad Leach” because of a business partnership he had with Adam’s father.

“According to coach Leach, Craig James told him in August of 2009 that he had a business relationship with Kent Hance,” Dobrowski said. “Then, in December of 2009 when this investigation was beginning, coach Leach had another discussion with Guy Bailey in which Mr. Bailey advised coach Leach that he was going to send his assistant along with Ms. (Charlotte) Bingham to conduct her investigation because Mr. Bailey feared that coach Leach would be railroaded due to the business relationship between Kent Hance and Craig James.”

Bailey, in a response statement released Tuesday, dismissed the claims by calling them “patently false.”

Hance issued a similar statement denying any partnership with Craig James. Rebecca Shaw of Spaeth Communications, which is representing the James family, said a business relationship between Hance and James “just doesn’t exist.”

In another instance of outside factors in the petition, the investigator — Tech attorney Charlotte Bingham — doubted the investigation would yield any real problems for Leach. Citing Leach’s account, Dobrowski said Bingham made a recommendation to the Tech Board of Regents to “call the James family up and tell them not to call anymore.”

But several days later, according to the documents, Bingham left a voicemail with one of Leach’s assistants advising him, “to the effect, ‘This thing is heating up. There are outside forces affecting this situation that I cannot control.’ ”

Dobrowski said he has a copy of the voicemail, but did not explain the “to the effect” clause in the court documents. Calls placed by The A-J to Bingham’s office on Tuesday afternoon were referred to the university’s spokesperson.

Adam James’ character — and the allegedly unwelcome influence of his father — is also brought into question in the lawsuit.

The documents refer to a September incident in which coaches reportedly told James he would be made third string for his attitude. Furious, according to the documents, James screamed profanities and stormed out of the office, slamming and breaking a door on his way out.

Then, according to the lawsuit, James’ father called an assistant coach and left a message saying, “You don’t know what you’re doing. Adam James is the best player at the wide receiver position … If you’ve got the b—- to call me back, and I don’t think you do, call me back.”

    Team Leach is the last thing that is needed. Leach felt he was more important then the team for the past year, just talk to some of the players. I don’t like Myers either, but it is obvious that Hance gave Leach more then enough opportunity to correct what they felt he had done. Sometimes even if you don’t feel you have messed up you have to swallow your pride and move on. If he had done that then he would still be employed and life would go on. As we find it now he is unemployed and low and behold life is still going on.

    They’ll have a tough time getting around the sovreign immunity defense. It’s well establised in State law and, even if the local district judge rules in Leach’s favor on that point, it’ll go all the way to the Texas Supreme Court. That’ll take a year or two and then all you have done is find out if the case can even be heard.

    So far it is Hance’s story verses Leach’s, but Leach’s is in a court document not a TV interview or one of those biased A-J PR pieces. It appears to me that the only way Hance can clear his name is to accept Leach’s challenge and let the truth come out in court. It will be interesting to hear what Bailey and Bingham have to say under oath verses what Hance then claims.

    I saw in another blog what might be a great idea. I am sorry I do not remember which blog of who recommended it. The idea was to better represent what is now known as Team Leach to change its name to “Team Truth.”

    I sense Hance will now be willing to settle this out of court. The bad news is the truth may never get to us. The worse news is that Hance, Bailey and Myers will still be at work (though I would hope they would be looking for an opportunity to transition out gracefully). The good news would be that after we all release our joy/grief of the settlement, we can get behind our school and like I have said before, get on about the business of being the best university on the planet.

    Hance, be a leader for a change and just quit. Your capability, your ethics and your honesty do not live up to Texas Tech standards.

    TEAM LEACH should rename itself TEAM HYSTERICAL. Screeching like a bunch of jilted brides AND hysterically funny. I’m guessing most of you never held a job. Otherwise, you’d know that cursing out your employer (even if he’s wrong), refusing to respect your boss, and suing the company you work for are not likely to work in your favor.

    And while TEAM LEACH mourns the loss of the great TT pirate, remember that EVERY YEAR, as his ego grew and GREW, he looked for a job somewhere else. Ya think he loves you? Ya think he cares about Texas Tech? Nah. If he did, he wouldn’t have tried to leave at the end of each season.

    He brought the program to a whole new level, and for that, we owe him thanks. But the man was VERY well paid for his work, and he had a sweet deal in Lubbock, where the demands/expectations were never that high for him. (You think they’d be happy with an 8-4 Alamo Bowl season in Austin?)

    If you want to be mad at the Administration, go ahead. But taking our our misplaced fury on the new coach and the team is only going to hurt the football program for which you profess to care so deeply. Seems more like TEAM LEACH, with all their groovy conspiracy theories and all, is simply searching to fill their empty days.

    Please, though, don’t call yourselves fans of the TTU football program. If you were fans, you wouldn’t be working so hard to tear it down.

You are for or against, not both. Team Leach should be called Fire Myres to bring attention to real issue. Leach is gone, there is no way he should have supporters still wanting him to get his job back. It’s not going to happen. Team Leach is 60K strong on Facebook but I’m willing to bet 60% of the people joined a day or two after Leach was fired and then have since jumped off of that band wagon after all of the new details (I know I have!).

    I agree with Mikey. I was one of those who was FLOORED by the way the administration treated Mike Leach.

    However…. I will always be a Red Raider, and now support Coach Tuberville and the Team.

    That doesn’t mean that I haven’t called or e-mailed the AD, President, and BOR several times to rationally and calmly make my concerns known. It also doesn’t mean that I have not called and e-mailed Governor Perry to request a review of the current BOR and that he request a copy of all e-mail from the past 2 months. They are public record.

    No matter what we feel about Leach is incidental regarding whether our beloved university is being run by someone who uses the lack of truth, the lack of ethics and the lack of managment skills to run this institution. This is bigger than football. If Hance dealt with the Leach situation this poorly how many other times has he ran people off illegally in other departments. They may not have had the money to fight him like Leach. How many times has he represented us through false stories and manipulation damaging our reputation. How many times has he allowed entitlement to manipulate the workings of Texas Tech. Even if you hate Leach, he is still fighting our battle for truth whether he gets a dime.

    If Hance is 100% right in everything then I will be glad to apoligize, but without the continuation of the public pressure we will never know. If he is wrong in little or all, without investigation or court action, he gets away it and will be allowed to continue and it will only get worse.

    We need Team Truth!

    I find it funny how ppl on this website and ppl who post here just “WRITE OFF” what Mike Leach did for this program, this city, and us as fans. HE is the one who made Texas Tech what it is today and yet everyone seems to forget this. Tommy Tubberville is not as great of a coach as he has been talked up. You ppl here will see what a mistake it was firing the BEST coach in College Football come this time next year!!!

    His defense should be the truth, as he has stated all along, being that on two separate occasions he told the “trainer to put him in a dark place near the practice field.” Nowhere has it been said that Leach told him to put him in “that” storage shed or any other “shed”. This was an act on the “trainer’s” part, not Leach’s!!

    Honor gets lost when greed and selfishness come into play… And the signs come in how big dogs treat the lesser high profiles in the stories… Tech’s top dogs have been treating employees with no respect for a long time… it has culminated to this thing with Leach… their behavior has been culminating…

    Does it matter? Does it matter that they have a long string of sad souls that have experienced unprofessional workplace, employment abuse… that were NOT handled, unresolved…where lives were harmed… people harmed… and now it has come to something larger… if this doesn’t matter to you, I must say that you are not supportive of the whole school… this isn’t about a coach or football in general.. this is about a very virus-like element in the school that is being allowed to fester and grow like an aggresive cancer. If you care about Tech, please voice your concerns. Do the research… read the archives and see what has gone on under Hance’s watch and what has been shoved aside, mishandled or not handled… there is a problem and pattern with honor and respect of hard working employees. It’s in the stories and archive of past and present. Decide for yourself if this leadership is acceptable to you and imagine the treatment of people happening to your son, your daughter, father or mother and ask yourself if it would be okay if it happened to someone you love. The current regime at Tech condones employee abuses and doesn’t right the wrongs so blatantly there. This flaw has culminated into a huge bottom line hit — when will it end? When Hance goes back to his law firm in Austin? When Gerald retires… when boosters and out of line regents decide to get the heck out of the sports management business? OR must we wait that long to put things into perspective?

    I fully support Team Leach because it’s not about trying to get Mike Leach back (that will never happen) or bshing the new coach or the James family. It’s about dealing with corruption inside the Texas Tech administration. If the football program falls apart, it will be because of the administration’s choices, not because of Team Leach. Team Leach is just looking for answers to what really happened.

    And, I still fully support the Red Raiders! Just not the administration

    Have there been previous instances of “horrific power abuse” and “corruption” among the administration that caused you to flame the blogs? Did you ever write to protest the unjust treatment or firing of ANY OTHER TECH EMPLOYEE? If not, one can only assume that you’ve been happy with the Administration until now.

    I believe the Administration handled the Leach situation badly, but then again, so Mike Leach. If you want to get self-righteous about defending a millionaire pirate coach, you probably could get REALLY worked up about the way lots of us less pampered folks get treated on the job every day.

    Will you start a new team and start yelling for us, too?

    Also give Bob Stoops a call and see what he thinks of Mike…or Art Briles, or Kevin Sumlin or any of the 300+ Texas high school coaches who run his offense…

It is hard for me to dismiss the wrong doings that this administration has done to OUR Beloved coach. I do get upset sometimes, and for the language on a previous post I do apologize.

    A football team that has never played for the BIG 12 Championship.

    A men’s basketball team that has been to the NCAA tourney ONCE SINCE 1997 & draws 2500 fans.

    A women’s team that has been to the NCAA tourney once this in 5 years & draws 1000 fans on a good day.

    A baseball team that has had trouble even making the BIG 12 tourney , much less the CWS.

    A University owned golf course that has a double wide for a clubhouse 10 years after the course was built.

    Add to that the constant bemoaning of how broke the Athletic Department as a whole is.

    Then answer this: How many elite schools Athletic Departments are run by a washed up basketball coach? Florida? Penn State? UT ? ou? USC? Ohio St? LSU? bama? Georgia? Va Tech? Not ONE OF THEM.

Kind of “user” mentality but that is the type of people who run the show behind scenes at TTU.

Just using the extremes, if Leach was totally out of line or if Hance and Co. totally mishandled this and lied about it, then so be it. At least we have the truth.     Leach will have a tough time getting around Tech’s sovereign immunity defense. It’s well establised in State law and, even if the local district judge rules in Leach’s favor on that point, it’ll go all the way to the Texas Supreme Court. That’ll take a two or three years and the only thing that has be accomplished is to find out if the case can even be heard. In the meantime, most or all of Leach’s coaches are out of work with no immediate prospects.

Give me a break!! A spoiled child running to a helicopter daddy, and the Tech administration uses this as a reason to fire Mike Leach. They did not like Coach Leach being a national figure, he overshadowed the egos in the Tech administration.

    He has never cussed anybody out and if you could think a little outside your small mind you would put it together that Leach never said a thing while Myers, Hance, and Sowells were trying to sabatoge and get rid of him after an 11-1 season!

    Looking at the Sowells letters that are now public would you not question Hance and his cronies instead of taking their word that he cursed them out.

    He may may have said something but it was only after Hance threatened him 5 times with his job on christmas eve because he would not sign a document that would have let the university off after such a “sleazy” firing.

After reading the paper filed, it is plain there are two distinct and different views of what transpired. This is a black eye that will affect Red Raiderland for a long time and those of us who love the university will remember it and will show our disgust for those people involved for the rest of our, or their, lives. Those who think Mike Leach would still be here if he had signed that “letter” are very mistaken, as the evil parties had planned this for about a year.

If they weren’t being paid, they wouldn’t have a thing to do with you.

    I have loved and supported tech for more than 30 years. I have seen some great moments and some amazing upsets through the years, but rarely has our football program ever been seen as so dangerous and so legitimate, especially against the bigger names in the conference . . . until Mike Leach came on the scene.

    I am very interested in the results of this case and wait with great anticipation to see what the legal case will produce and explain. Both sides are acting like they should in a legal case. You can’t say everything or you lose your position in the trial. They will settle or the truth will be exposed.

    My last word here is to say this. I have known Kent Hance and his family for more than 30 years, and I have watched Gerald Myers since he coach basketball in the 70’s. At no time did I ever have a doubt or a concern about their ability, their skill set, or their motives; until recently! I don’t think the way the contract extension talks last November, December, and January were honest and didn’t appear to be completely above board. The e-mails that were released make things look really suspicious. Time will give us a better perspective! I love tech, I support the players, and I am excited about Coach Tubberville, but I still want to know the truth. If Mike Leach was improperly fired, the university owes him everything they took from him and the administration should pay the university back for what they cost us. That includes their finances and their jobs. May the truth unite us all again.

    Note to George, Head Coaches dont get “immunity” from those type documents in a court of law either, if the “real” truth is known.

    This gal from PA has great respect for a coach whose team was 8th in the nation in graduation rates in 2008, and first in the Big 12 for 2009. That shows me a lot about Coach Leach and his priorities for his kids. Here’s hoping the truth comes out, as the defamation of this man’s character is something none of us should accept without clear, objective evidence of wrongdoing. As an institution of higher learning, TT should realize that sometimes the most life-defining lessons learned by students in college are not those found in books.

    I think the anger is dying down as everyone has their lives to live and after all it is just football. I do not support Hance or Myers but I am ready to move on. Why would Lubbock people award Leach a bunch of money knowing it will hurt Tech’s pocket book and go to the lawyer in camoflauge and the one that does not know the right name of the problem child.

    I frankly am relieved to have a new coach now knowing that Leach was going to leave as soon as he could anyway.

    I hate the thought that if Hance and Co. are guilty of lying, manipulating and causing harm to Leach, others in non-athletic departments and Texas Tech itself, and we have a chance to do something about it but do nothing, what good was our education there? Without a public outcry the lies WILL be covered up. If it takes permission from Texas to sue Hance, then it will take noise, attention and voters to get them to agree to let the trial happen. It may take Team Leach and its 60K+ members to prevent a documented helecopter dad from being a state Senator. As I have said before, this is a lot bigger than just Leach and the football team. The main thing is it is about doing the right thing.

    I am certainly not trying to push my beliefs on anyone, but as St. James wrote, “Anyone who knows what to do and does not do it, it is sin.” If one screams it is a noise, if 60,000 scream its a roar. We have to do something and there is no other means to participate other than what is known as Team Leach.

    But, it is not about Leach. He is just a object to a means and a means to and end. Tubberville is the coach and as I have said before, I do not agree with everything he is doing but he is the coach of the college team I love and I hope he takes us all the way to the top. Team Leach should be called Team Truth. We are working hard to ensure the truth is revealed – from whomever is lying.

    I was born in Lubbock across the street from Tech; picked cotton in the fields before there were machines to do it; went to high school at Coronado and was dirt poor. Thanks to an education at Tech I have done quite well – including running a business George (publicly traded, excess of $1B in sales and over 8,000 employees). I now live in the southeastern US and talk to people over the country and world daily. I am known to be a Texas Tech supporter. Over the last two weeks not a single person has laughed at Team Leach. They have laughed at Texas Tech and that hurts.

    You may be willing to let Tech rot from within, but I am not. I am doing everything I can and Team Truth is a help.

If they asked him to apologize on behalf of Tech and he refused, if he even cussed at his boss- Hance, if they asked him to not coach while they conduct an investigation and were paying him for this down time and Leach refused to abide—– HE IS TOAST !! Then if this werent enough TECH cant be sued anyway. They have immunity. I like Leach but he isnt as smart as I thought. Not knowledgeabe about the LAW !!!!     Tuberville is not the story at Tech and we shold keep focus on the real problem. This story is totally about Adam James character and the fact that Texas Tech had grown to dislike Coach Leach and wanted him out of there at the cheapest cost to them. Craig James utilized his job at espn to highten his sons version of the story and that does not mean that it is the truth. Until I here Coach Leach speak directly on the topic, I can only speculate. There has been those in support of the coach come out while he was suspended and now that he is fired, I am sure those against the coach will start to surface as well. In all things in life, there are those that agree and disagree, those that approve and disapprove, those in favor and those against. Its all a matter of interpretation and this will be no different. The fact is there are plenty of kids like Adam James that are in a unique position and many of them take full advantage of it both positively and negatively. Coach was doing what he felt he needed to do to create an enviornment were athletes will give 100 percent and help him win football games. Maybe he is too old school most people across the country but remember he is in texas and that is a very different enviornment then most. Right or wrong, Craig james used his influence to bolster Texas Techs Witch hunt and runout a good football coach.

    Coaches sue universities all the time over contract disputes. Leach will have his day in court. If “sovereign immunity” is granted, this will definitely be refiled as an EEOC suit, which in turn can sue anybody they chose to.

Based on the time of the events it does appear the university took adverse action against him for filing in good faith that the university was violating the conditions of a legally binding contract. It seems to fit in pretty well with the whistleblower act.

    Mike has been fired and will not return. He was fired in a very unprofessional manner by and administration that is full of incompetence. Gerald Myers, Guy Bailey and chancellor Kent (republican lobbyist) Hance who hired Alberto (I can’t remember) Gonzales to teach one course of 15 kids for $100,000.00 a year That is $850.00 per course hour. Nice work if you can get it. In case you do not know who Alberto (I can’t remember), he was the Attorney General under George W. Bush who tried to politicize the justice department (Remember separation of powers in the Constitution) and tried to fire all the U. S. Attorneys that were not conservative republicans. This man lied and refused to testify to congress and resigned under pressure. He was unable to get a job until chancellor Kent (republican lobbyist) hired him. These people had outside help with Jim Sowell and Craig James. We will leave Crybaby James out of it since he doesn’t have the gum,ption to stand up to anybody.

    Tech needs to clean house and they will not do that as long as governor perry backs his bad decisions that brought everybody here.

    Leach will have a tough time getting around Tech’s sovereign immunity defense. It’s well establised in State law and, even if the local district judge rules in Leach’s favor on that point, it’ll go all the way to the Texas Supreme Court. That’ll take a two or three years and the only thing that has be accomplished is to find out if the case can even be heard. In the meantime, most or all of Leach’s coaches are out of work with no immediate prospects.

    The truth about last year’s emails? Well, if you remember, Leach flew to Seattle on December 2, 2008 to interview for the University of Washington job. Then Leach tried to get an interview with Auburn. Not surprising some people were not happy that Leach was out looking for another job while under contract with Tech and when he should have been getting ready for the Cotton Bowl. Seems that Sowell wanted to make sure if Leach kept looking elsewhere, Tech should be able to fire him. Many coaching contracts have clauses prohibiting the coach to interview without permission. Leach’s contract did not have such a provision. That was the big snag in last year’s contract. “The provision that bothered Leach most is one that would trigger his firing and a $1.5 million penalty if he interviews for another job without athletic director Gerald Myers’ permission. Leach’s current deal has no such restriction” http://sports.espn.go.com/ncf/news/story?id=3914101 Leach won the point; the new contract had no such provision. It didn’t even have a buyout clause.

    Hance and James are not in business together. Both deny it. I understand the admin haters discount the denial, but without proof that is all you have. You cannot prove the existence of something that does not exist. The only one saying it is Leach, and he offers no proof. Team Leach jumps on this like it is gospel without any shred of evidence. When it comes out to be false, will Team Leach admit that the pirate is a liar? They are quick to say the administration lies but have no proof.

    Finally, Leach can sue on the contract. Immunity only applies to his other causes of action. Of course if the university is right and he was terminated for cause, he is zeroed out. If he is right and he was terminated without cause, he would be due his base salary for the remaining years on his contract (about $1.2 mil)

    Lesson to be learned? “Don’t listen to your inner pirate if your inner pirate is an idiot.” Pirates have no regard for rules or other people.

    I understand your frustration and maybe I have read into your statements more than what is there, but we do not want to hurt Tech. Take the money you normally give to Tech; the financial equivilent of tickets, shirts, etc. you normally buy; the extra’s you would spend in supporting Tech; and put that money in an escrow account. When Hance and Co. have been dethrowned, then give that money to the school. Make it known that is what you are doing so the state knows there is a positive financial reason to settle this Hance allowed and/or generated fiasco. Let them know the money is there but you cannot and will not allow the current administration to abuse the financial support you give.

    Please stay a supporter! The school itself has done nothing wrong and it and the students who attend Tech need our help.

    I’m, in one sense, glad the firing of Leach happened. The lack of integrity, bad behavior, and incompetence of the administration has been fairly common knowledge for a while. But most people didn’t care. It takes an event like the firing of a celebrity coach (basically a provider of entertainment) to finally make us look at the overall picture of corruption, cronyism, and incompetence that is messing up a decent university. We’ve all been aware of it in a minor sense for a while. You see it in the way the city is run as well. Good old boys, money, and politics. It’s always nice to see the sheep wake up to the truth a bit even though they’re part way through the shearing.

    1. Adam James knows he is not going to be playing much, if at all in the Alamo Bown, so why practice?
    2. Adam gets in a fight and takes a blow or two to the head. Apparently too lazy to duck. Though Dad would take the blow for him again.
    3. He reports for medical attention and is told he has a mild concussion. He knows this secures the fact he will not play in San Antonio.
    4. If not playing why still be in Lubbock? He may as well go home so he can hang out with old friends.
    5. Knows Leach will say “no” because it is unfair to the team so he comes up with a plan. Get sent home.
    6. He pushes the buttons he knows will upset not only Leach but all the coaches – lazy and attitude. He is told to “walk the field” like everyone who is in his condition is told to do. He, in front of all the coaches and the entire team, never get more than 40 or 50 yards down the field. It backfires when he is sent to a building larger than any dorm room and most off-campus apartments. (Was larger than my converted garage apartment and I did not have an ice machine, a fan and medical attention right outside the door.)
    7. Adam then shows up really pushing the buttons, being in street clothes with sun gla$$es and cell phone – all known no-no’s. Leach can’t send him to medical because it is a discipline problem. He can’t send him home because it is a team violation and he can’t do that to the team. He can’t make him sit and watch because it is a determent to the moral of the team. He has to keep him close and there is no other place other than the media room. Adam can’t believe he didn’t get sent home, so while he sits there he devises a plan and calls dad. Dad, who like Hance, does not bother to actually search for the truth, goes into knee-jerk mode. (A fine qualification for a senator or chancellor.)
    8. Adam is not sent home for Christmas, but thanks to his dad and the Tech administration he has become an internet media darling – such as the “Who is Tougher than Adam James” websites that show up all over the country. Showing things like kittens. (an example of one: http://utefans.net/message.php?id=950102) Google “Who is tougher than Adam James” and see there are sites from Alabama to Ohio to Utah. Great press Dad. Did Spaeth set these up too?
    9. Craig James and Kent Hance realize this an embarrasement to themselves and their families so they take advantage of a bad thing and point the finger at a common enemy.
    Just a story.

    I just heard that Lincoln Riley will not be retained by the Tubberville staff. He has been released from Texas Tech. This is an absolute STUPID moved by Tubberville. All of our recruits on the offensive side of the ball were recruited by Riley, and now that he is gone…….. You can kiss all of our 4-Star recruits gone as well. The only chance we had of holding onto those recruits on the offensive side of the ball was to keep Riley.

You have stated your view many times on this and appear to be at least near my age, so I turn to you for clarity. Please help me to understand why standing and sitting and sleeping in an unlocked garage sized building and a media room with a trainer outside the door is so bad.

    Would have it been okay if he would have gone inside and had to sit in an even smaller office? If yes, help me to understand the difference. Would it have been better if he had made James do some other sort of exercise instead of the walking he was a$$igned to do, but did not – in street clothes with a cell phone? Would it have been okay if he did not have a mild concussion? If so, how does that really make a difference since all he was doing was fooling around while he was in there (i.e. the cell phone video)? If you had been in Leach’s position those days, what would you have done instead? These are questions I have and makes me unclear on your viewpoint.

    I am not looking for a fight or to enter into any sort of name calling, I just want to know what it is I may be mi$$ing. I am truly open, but do not understand your side. I leave myself open to your clarifying. Thank you in advance.

    Very briefly — and I know I’ve said it before — what Leach did was in my opinion was wrong. Adam James may have been a slacker. He may be lazy, rich, cocky, self-centered, arrogant, etc. But no matter if these apply to Adam or not…. he was diagnosed as having a concussion. A concussion should be taken seriously. As I understand it Coach Leach was very miffed at Adam for showing up in street clothes and not prepared to practice. Leach lost his cool and had Adam held in a shed, or whatever. And yes I know this place was not a maximum security prison but that’s irrelevant. Leach let the circumstances get the best of him and unwisely decided to humiliate Adam, and I’m sure it worked. In my opinion Leach could simply sent Adam to his room and dealt with him later. At some later time he could have started procedures to revoke Adam’s scholarship if he felt that strongly about it.

    Later, Leach was asked to apologize for his actions. Believing that he was untouchable, he refused.

    It’s a sad situation. Leach lost his job and I’m sure Adam will be pressured to leave the school. I know I’m in the minority here…. and that’s ok……. Leach got Leach fired. I hope he gets a chance to work his wide open offense at another school or perhaps the NFL. It is exciting football.

    Of course Perry appointed the regents and he is going to make sure whatever is discovered is beneficial to him sine most of Team Leach administrators are pro Perry.

    Ain’t it great Tech fans? We’re essentially back to boring Spike Dykes football. And all for NOTHING…..not one thing. Writers are saying Tech could have been in place to compete for #1 in the Big 12 South division if Leach had stayed. But now, even if they do well, it won’t be the same. Back to boring, mediocre football and trying to convince players why they should come to Lubbock to fight the dust and play in just another boring system. Don’t forget, this “great” new Tech coach went 5-7 in his last year at Auburn. Great coaches don’t go 5-7. They just don’t.

    I realize people are touting the new offensive coordinator as the best thing since sliced bread. But the facts are….NOBODY did it as well as Leach and it wasn’t even close. We HAD the best coach and got rid of him for nothing.

    Texas Tech nation seems to know they are being played for fools. But there’s nothing we can do….except protest loudly by withholding our support and money. That’s not going to happen, no matter how mad people are about the Leach situation.

    Talk about deja vu. This is going to be like going back 15 years. Back to when people heard the name Texas Tech and just shrugged their shoulders.

    We have been lied to, and we have Myers, Hance and Bailey to thank for it. And this new Tubby coach…..he’s not exactly starting out well by lying to the Tech faithful. He said nothing much would change. And ever since he arrived, it’s done nothing BUT change, and change very significantly. Even Gil Brandt (of the Dallas Cowboys) couldn’t believe Lincoln Riley was let go. In his words…..”If you can find a better 26 year old offensive coach, I’d like to see him.” But Tubby threw him aside like trash. This doesn’t exactly look like we have the brightest guy coming in.

    1. How did being in the “shed” have a po$$ible adverse effect on James’ concussion. I sense you feel it was unnece$$arily humiliating, but I have not yet made the connection regarding the concussion. Am I to a$$ume if he was a good player in perfect health and just did some bone-headed thing that players do, it would still not be okay to use the “shed” (though we may all have been taken out behind the wood shed in out younger years.)
    2. Do you believe James should have been forgiven for his behavior at those practices and allowed to remain on the team? And in that same light, do you feel Leach should have been forgiven (by Hance and Co.) and allowed to coach the Alamo Bowl and remained coach? I know this gets into whether Leach feels he did no wrong so what is there to apologize for, etc., etc., but what I am looking for is if Adam James had not called daddy, therefore daddy would not have called the regents, but if Hance just happened to be observing practice and he asked about it, would he then have done anything? Meaning either he would not thought it was any big deal, or he would have forgiven everyone and moved on, or we would be where we are now? Not sure I wrote that clearly but hopefully you can make out what I am asking.
    BTW, I am 60 and also a Viet Nam vet.

Looser managers say one thing to your face and do horrible things behind your back….aka politicians. Hance has got to go. Remember what Mahatma Gandhisaid, “A “No” uttered from deepest conviction is better and greater than a “Yes” merely uttered to please, or what is worse, to avoid trouble.” . Therefore, Bailey has got to go and Myers has got to go.

I am thinking the above is enough for a good defense by Tech, though one could question if that decision was in Tech’s best interests. All this is assuming Tech cant hide behind immunity. My guess is Leach is about a 50 to 1 underdog at this moment. If Leach doesnt think James was treated wrongfully, but Hance and his group did- then Leach as an employee was insubordinate by not following their instructions.. I think the worst judgement was Leach’s not waiting til after his 800,000 bonus date passed. He now would have to prove that Tech fired him days before this purposefully inorder to avoid that payment. Thats hard to prove given Leach was the one pushing for an earlier decision. Leach cant win at this point because he has made himself almost unemployable in college football. his claim that Tech intended to fire him when they extended his contract is nothing short of insanity. I dont support the decision to fire him. I do support Tech had every reason required inorder to fire him. Leachs offense this time was a big gamble and it looks like its a 3 and out, or 4th and 35 at best. That James or Hance arent good guys really isnt a factor in this court case, is it ?

And the humiliation… to a degree… will last a life time. The way I see it Leach’s attitude was “concussion or not I’m locking you up.”

    2. “Shed time” for a player in perfectly good health isn’t a big issue with me outside the fact I believe a coach could find more effective ways to “adjust” a player’s poor attitude.

    3. I believe if Hance had visited the practice field and found Adam was locked in a shed that he would have confronted the coach, which of course is complete conjecture on my part.

    He has been incredibly successful as a businessman while also working as an attorney and lobbyist. He has amassed quite a fortune, and he is a self-made man.

    He played basketball and was apparently pretty good. He became good friends with Coach Bob Knight, and I believe the Chancellor has endowed one of the basketball scholarships. That puts him in a rare breed of Tech athletic supporters.

    He was a professor at Tech back in the 70’s. He had a law practice here in Lubbock. He grew up in West Texas and represented West Texas in Congress. He’s not someone just passing through.

    He gave up millions of dollars in personal income annually to provide his unique expertise to Tech.

    He has donated a lot of money to Tech, and he has raised a huge amount of money for Tech.

    His primary goal is to get Tech to the Next Level. That means Tier I funding, though he would also love to help Tech get to the Next Level in football. He is uniquely qualified and connected to lead the Tier I effort, and he has helped make Tech the leader in the clubhouse for this funding.

    Chancellor Hance went out and raised the additional money needed to get the stadium expansion moving. Construction would not have gotten underway on the Easy Side without the Chancellor’s campaign and personal contacts.
    In the worst economy in modern memory, he has raised more money for Tech than any previous Chancellor.

    He is extremely well-connected politically as a former United States Congressman.

    He is a great PR guy — wonderful speaker who entertains people.

    He loves sports. I am sure Tech has never had a Chancellor who loves sports as much as Chancellor Hance. Few universities have.

    If my highest-paid employee had done something like this, and since it was a Board member who brought it to the attention of the Tech Administration, a Board conference call was totally appropriate. If I had been on the Board, I would have recommended his termination, too, unless we could be assured that nothing like this would ever happen again. Even then, I might have voted to fire him on the spot. As a corporate CEO for most of my 40-year career, I would have been scared to death about the legal implications and naturally concerned for the well-being of every student athlete. What if this happened to Sticks or Batch during the Spring and, Heaven forbid, one of them died? Then it comes out that Tech’s football coach had been accused of this before, and the administration did little or nothing. Can you spell punitive damages?

    The facts of what really happened have been horribly distorted by the ridiculously insane Pro-Leach people.

    Chancellor Hance absolutely did not want this to happen. I know. All Leach had to do was PRETEND to be a decent human being. If he had acknowledged “receipt” of the policies for human treatment of student athletes, he would still be coach. If he had simply bit his lip and kind of apologized to the James family, he would still be coach. If he had agreed to not put student athletes at risk, he would still be coach. If he hadn’t sued his employer, he might still be coach. Thank God he didn’t do any of those simple things, because Tech know has one of the top coaches in the country – one of the only major college coaches to ever have two undefeated seasons. We also have the Assistant Head Coach from the national champion Alabama Crimson Tide as our Defensive Coordinator.

    What has Chancellor Hance done for us lately? Many have said that if a team just had the quality of defense played in the SEC with the quality of offense played in the Big 12 South, it would be hard to beat. We’ve got the coaches now who have demonstrated the ability to make this happen.

    For me, there are so many things about your post which I totally disagree. But I will keep my comments to my opinion about Hance. He may have been a wonderful child, a model student and the greatest thing to have ever driven through Dimmitt. He may have accomplished a lot in life and be known by important names throughout the world. He may have given tons and tons of money to Tech and starving orphans. BUT – liars are liars and it is my opinion he is a liar. If you spend time on the internet you will find that not everyone loves him as much as you. Many believe he is little more than a mafia don. Thanks to his mishandling of the Leach situation there are people now digging where others did not dig before and they are specifically looking for him. I believe he is a dear friend to many, but has no problem sleeping at night after manipulating deals that cost people their jobs, self-respect and possibly their lives. Just my opinion, but you do not have to scratch the dirt too deeply to find his negative influence. He should do himself and Tech a favor and get the hell out of Lubbock.

    Joe said it correctly above. TTU football will be just another one of the booring programs dominated by running and strong defense. TTU will resemble Alabama to some degree.

    Tubs says he wants to keep the spread offense but fires anyone at TTU with any experience along those lines at the college employing the spread offense with the most success.

    Kent Hance needs to go. People talk about Mike Leach being an egomaniac. We can clearly see who the egomaniac really is. Mike Leach could have very well been an egomaniac. But, Bobby Knight was not? Bobby Knight punched the AD and chased him around the salad bar at a local restaurant and into the parking lot afterwards. Perhaps that was what ML should have done to earn the chancellor’s respect? Instead, they called ML insubordinate for punishing a smart a$$ed kid who was 12th on the depth chart for being number 1 on the pest chart with he and his helecopter dad double-teaming the coach for more playing time.

    Adam needs to go play at SMU. I will boo him when he steps on to the field everytime.

Spike was fune and down to earth and we had a couple of good teams……but for years….the only teams we would fill Jones Stadium for was the annual tu or atm games or if by chance we brought in a big name school to play in our stadium.

    Last year when Tech was trying to settle Leach’s contract, I did research on the past years. Only during the Leach era did Tech fans FILL Jones Stadium for the likes of Southeastern Louisiana, UTEP, Nevada, SMU, SE Louisana, Eastern New Mexico, North Texas, etc. Approximately 30,000 fans was about the average before Leach for those pre-conference schools and lower conference schools in the days of the Southwest Conference. During Leach……48,000 – 50,000 fans.

    Folks, start doing some simple math when the attendance at Tech games goes back to the days of old as far as attendance goes. 15,000 fans, mostly from out of town, tickets not sold, hotel rooms not rented, meals not eaten, merchandise and automobile fuel not purchased…etc…the City and Community of Lubbock loses.

    A conventional offense and a good defense will a) not get athletes to Lubbock, b) will not be exciting, and c) not bring attendance to home games.

    Tech fans have proven over the years to be fickle……….”fair weather” fans………. We need excitement… entertainment……. potential of something big to happen. We filled up United Spirit Arena under Bobby Knight………. for that very reason. Even Bobby Knight could not bring the caliber of athlete to Tech to rise to the upper echelon and consistently compete but we filled the arena for the excitement, fun, entertainment and potential for the unknown………

    Under Leach we all…me included ….got behind Tech teams over the last 10 years that had average won-loss records because it was exciting…win or lose. We witnessed more than several times our Team beating others with Leach’s style. No one out there has shown …yet… to be as successful or make their team as exciting as ours. Leach wanted to be at Tech……

    Our style filled Jones Stadium, brought National attention, allowed for not one but two stadium expansions, put athletes in the Pro’s….pick something…… it all added up to financial success… and was fun.

    From a business perspective….Hance’s move will prove to be a financial disaster.

    Someone with real business knowledge please tell me how “insubordination” makes for THE reason of firing someone that has the highest level of financial impact on a “business” that Mike Leach has had……… Please tell me they have something more than “insubordination”…….

    As for “dribble, dribble, pass, pass” Gerald Myers….I agree with one blogger’s post from a few days ago…………. no other school has a former NO GOOD basketball coach as their AD. I watched Gerald Myers ruin some of the best athletes with his stupid style of basketball, scream and yell at kids on the bench and demean them in front of all the fans……….he is worthless……..

    Down here in Texas nobody messes with Texas University for very long. Some who do, go away quietly as the Hogs did. Others who build there programs up enough to be competitive with the University find themselves in trouble with the NCAA, ie. SMU, TCU and the University of Houston. If a competitive University has influence, Coaching problems may arise as it did over the years at A&M. If you recall some strange things happened dating back to Bear and Jackie Sherrill. Not to mention that craziness that went on with Francione. Remember he left the mighty University of Alabama in the middle of the night to go and wreck the wrecking crew at A&M. Maybe if he was influenced by a third party it would explain why he did not have the courage to say good bye to his Tide. If you are not at least staring to wonder that something maybe going on behind the scene, I ask you. Who in their right mind would turn the Burnet kid who was like a Pro pocket passer in high school into a running option Quarterback in college as did Fran.
    Now comes Texas Tech and Mike Leach, as they move the ball rather freely against Texas and rise up and trounce Oklahoma in 09.When I heard the word that Tech’s Mike Leach was suspended for the Alamo Bowl game I thought it was a misprint. Then when I heard it was true and it involved the James family. Well, it’s just a rich white boy, son of a ESPN announcer who wasn’t getting enough catches. All year I wondered why they weren’t throwing to Craig’s boy more. Maybe looking back they should have. If the James’s were a bit disgruntled that might have opened the trap door for this coup.
    My thoughts were enhanced by a call from Bristol, the headquarters of ESPN. It was during the Texas vs. Oklahoma State game. The TV announcers were order to stop questioning the official’s calls. Well in case you don’t know, before the game got out of reach for the Cowboys, all the call were going for the Horns. So what they really meant was don’t blow the cover. So when I explain that what is going on down here in Texas, is more that just home cooking, I am not just whistling Dixie.
