Leach legal motion seeks expedited process
By Logan G. Carver | AVALANCHE-JOURNAL
As promised, the attorney for former Texas Tech head football coach Mike Leach filed motions Thursday asking a judge to speed up the information-gathering process in what could become a protracted legal battle with the university.

Ted Liggett, left, attorney for fired Texas Tech coach Mike Leach, talks with local media outside the Lubbock County District Clerk's Office on Thursday after filing motions calling for a speedy information-gathering process. (John A. Bowersmith/Avalanche-Journal)
Ted Liggett, Leach’s attorney, filed a motion asking a judge to force Tech to quickly turn over any information pertaining to the coach’s termination.
In addition to depositions of Tech Chancellor Kent Hance, President Guy Bailey, Athletic Director Gerald Myers and football player Adam James, the motion seeks communications between Tech and the James family and Tech and former Regent Jim Sowell, among many other communications.
The pleadings also request a March 1 trial date.
The case is assigned to Judge Bill Sowder’s 99th District.
Tech dismissed Leach last month, two days after suspending him, contending he had mistreated wide receiver Adam James and refused to cooperate with the administration.
Bailey fired him “with cause,” meaning Leach received no compensation or severance pay.
In Liggett’s motion for a speedy hearing on whether the university must rapidly turn over information, he claims it is “relating to his lawsuit against Texas Tech University for the wrongful termination of his contract.”
Although a December request for a temporary restraining order claims a breach of contract for Leach’s suspension, no lawsuit for wrongful termination has been filed.
Liggett hinted at future filings, but would not discuss what might come after the more than 100 pages of documents filed Thursday.
“The pleadings that have been filed today speak for themselves,” Liggett said.
The motion contends Leach’s dismissal will put him in economic duress without the ability to get information from the university quickly and go to trial soon.
The motion also states that the university’s allegations of mistreatment of a student athlete could make it difficult for Leach to get another coaching job.

If he was a real dad he would have done something about it then and this issue with Leach would have never happened. So Texas lost the Nat’l Championship game; maybe different if McCoy had been able to play, maybe not. One thing to remember however, they were playing and Tech was home watching on TV. The next time the sun comes up in the WEST is the next time Tech will play in a BCS National Championship game. They need to join the Southland Conference, play the same teams Knight does then play for the Div.1A championship. There are 2 good reasons why Tech will never play in a Div.1 championship; OU, UT.

Simple definitions of a “mess.” Was Leach the best coach Tech has ever had? YES. Did he interview every year so he could leave Tech? YES. Is Myers past due to retire? YES. Was Hance’s hiring based on politics not academic qualifications? YES. Is Lubbock a much harder place to recruit to than Austin or College Station? YES. Will Tech struggle to attract and keep a top caliber coach? YES. IT IS A MAJOR MESS!
The only ones to lose in the long run will be the Tech fans. I am a Tech grad and love the Red Raiders but the truth is nothing has really changed in the last 50 years. Lubbock is hard to recruit to and keep top caliber players and coachs.

Does anyone find it fishy that Ruffian McNeil was called yesterday for a “second interview”–the same day that Mike Leach filed his Motion for Expedited Discovery? It certainly appears as if Texas Tech is dangling a carrot in front of McNeil to change or slant his testimony. We’ve already seen the turncoats, Pincock and Phy, scurry to save their jobs as they equivocated in their affidavits about James’s injury and treatment. Unfortunately, the Head Coaching search is becoming a joke–two candidates–and one of them has never even coached a Division I team nor has he showed greatness. Granted he has improved one of the five worst defenses in the country to middle of the pack, but that is hardly a recommendation for greatness. He asks us to look at his body of work–so let’s look at his record as the special teams coach a few years ago—pathetic! I appreciate that the players love him and are familiar with him. It is natural that they would want to keep him, but I do not think that he is capable of handling the big picture–he does not have the offensive acumen and innovation that Leach has. Naturally, I expect him to be hired, because TTU administration has not shown one ounce of wisdom in this entire debacle. At any rate, it will be interesting to see what Ruffian’s testimony will be. Let’s see how much he values his “best friend” who gave him a break and supported him these last ten years as opposed to the carrot that Texas Tech is dangling. I guess they are counting on Ruffian’s ability to “work with Texas Tech leadership”–a basis for Leach’s termination according to one Regent. I wonder if this is code for “lack of ethics” or for just plan boot-licking.

I get this picture of Myers approaching Leach about a call he got from “a parent” – What the xxxx is going on! Do you have xxxx in your head! He can ruin us if this gets on the air. You have to apologize and you have to do it quickly. — I have no doubt that as a player he is worthless and has singlehandedly prevented the team from being the best it can, but his dad is looking at becoming a senator and he is po’ed. Much less he has gotten Hance all upset and Bert is ticked because he is working with Craig James to get the jerk elected. Therefore apologize. It doesn’t matter if you mean it, just lie and let’s get this behind us. — If you do not apologize then we will do now what we were planning on doing after the Alamo Bowl – can your xxx! I have no doubt he was safe in the garage and he deserved even worse, but xxxx Mike, his dad will twist this way out of reality and will do whatever it takes to make him look good. — I know this is upsetting to you but I personally don’t give a xxxx. Do it or quit, xxxxxxx!!! What did you say to me? Well, xxxx you too! Your toast! You just aren’t willing to work with us.
Yeah, I know, keep my day job because I am not much of a writer, but the Regents comments are so one sided. There is no doubt in my mind they handled the ‘discussions’ with Leach unprofessionally. Knowing these guys, especially Myers, it was at argument level before he entered the door. He/they were cussing withn the first few seconds and it all went down from there. If for no other reason than emotion, Leach had no option but to tell them to xxxx off. If they had bothered to listen, question, then listen and question again, and then investigate, the problem would have been handled and the school will be able to to keep $10M+ of its money and the reputation of the school would still be in tact.

Am I wrong, but in court papers it says “the plaintiff is Mike Leach, the Head Coach for Texas Tech…” In my mind I think Leach still thinks he is the Head Coach. If he wins would he not want to return? I think that says he wants it, though it does actually say that…

Who is that petty Scrooge “Who Stole the Leachmas”?? Too bad that the best option at offensive coordinator we got is that traitor and “brown-noser” Lincoln Riley, who stole the offensive schemes from Leach and then “threw him under the bus” by standing up for Leach one week and then turning around and retracting his statement to comply with his administrations agenda to fire Leach. What kind of integrity and leadership he brings to the team? He’s just going to be another swashbuckler but without pirate-type loyalty. At least, Leach was an odd ball and acted like one and stood by his statements. I hate Leach “sleazy lawyer” tactics during his contract negotiations last year, but at least he was what he was and we embraced him, but Riley is a petty Scrooge “Who Stole the Leachmas”.
Admin needs to act this week – Tuberville or McNeill – enough meddling as recruits families must be retianed committed to Lubbock.
I hope Leach gets interview with Oakland Raiders (perfect fit) and shuts up. Also, they said on TV that Alabama Defensive Coordinator is Tech graduate and will be interviewed soon by Tech admin, but…my problem with this is that Bama defense never saw the spread offense of the Big XII teams and partially that’s why they allowed UT to score 2 TDs in 2nd half (why would we need that coach then). I’d hate us to turn into a defense-oriented team as OU and UT will rob us of any good recruits. If we just keep our Leach-style offense, we can still get “the prime beef”. Hance must announce new Coach tomorrow!!

I’m not sure there is any name clearing to be done. Leach admits what he did, and doesn’t see anything wrong with it. His bosses do. I don’t think either side is saying the James kid was harmed.
This all boils down to the AD’s opinion of how the coach should conduct himself versus the coach’s opinion.

Why is Myers still at Tech — Fire Myers
Leach has said he doesnt think much of that kid and that his parents tried to wrongfully get him playing time. He is not trying to defend putting him in that shed was THE RIGHT THING TO DO, just that he didnt do it/ the trainers did and it didnt hurt the kid. Tech claims Leach wouldnt apologize to the complaining parents nor sign an agreement to never do that again …..though he didnt do that in the first place. I suppose Leach’s position is finally going to be that this is the trainers fault and that regardless this isnt cause for the termination of his contract ? Not signing an agreement, one that doesnt require him to break any laws etc, sounds reasonable given this complaint, and is likely ‘insubordination’. If leach DID order this act….case closed. I hope Tech prevails in the suit. Its a shame this happened but it sounds like Mike pushed things believing his popularity would make it impossible for them to terminate him. The kid may be a jerk, but why go crazy over him ?

Leach deserves the money, bottom line. Tech bullied to get what they want, but those types of actions can not be expected from a public institution that receives money from our taxes. Leach deserves to be “righted” and get his money that is owed to him and more due to harm caused by Tech officials.
The fact is, politics hand prints are all over this matter. Is it just coincidence that Craig James is now announcing his intent to run for US Senate under the republican flag. Did Hance (republican politician), Bailey, and Myers give to the republican agenda? Did Rick Perry have his hand in this as well? After all, is Perry supporting James’ bid for the US Senate?

FACTS:
1) Leach mistreated an injured player
>>>>> Wrong. He discipled an injured player. It is the opinion of his father, TTU admin and apparently you it was mistreatment.
2) Leach didnt take direction or cooperate with his superiors
>>>>> Wrong. He was told to do something that would have been a lie and no one is supposed to do that. Ask the IRS, the local police or any good Human Resources person.
3) An employer can suspend an employee with pay while conducting an investigation
>>>>> Right. And if they are proved wrong they have to pay all back compensation not paid. In this case the $800K. Leach was working through the legal system to ensure TTU stayed legal.
4) The contract allowed for termination with cause
>>>>> Right. Any good contract allows for termination with cause. The key is, you have to have a very clear cause and you must work within your own contract guidelines. This will all be explained in court and TTU will have to explain their actions.
5) Leach didnt own his business but was just an employee
>>>>> As a good employee he was trying to keep TTU out of court. It was TTU who forced this issue by demanding he sign apologies he felt would be false and documents they were only demanding he sign and not all managers who have to deal with injured students. This should have been a request for all department heads on all campuses. You do not single out one person unless you are trying to set them up to be fired. Hance and Myers are not the first to use this tactic.

Leach has said HE was treating this injured player by getting him out of the light. He wasnt claimed he was punishing this kid. Think is no other player that has ever had this type injury has been treated like this ever before at Tech ! Its not just me and the administration that think this is a poor practice.
When theres a third party complaint against a department or individual its not unreasonable to CORRECT that error. In this case TECH felt the treatment was inappropriate. MATTERS NOT WHAT THE EMPLOYEE THOUGHT ! Signing that agreement was reasonable.
Tech firing Leach ALONE for filing a restraining order for their rightful action of suspending him with pay is insubordination. THAT CAUSED BAD PUBLICITY AND DAMAGED TECH ! LEACH TOOK THIS COURT – not Tech ! Any employee that files a court action against his employer REGARDING A LEGAL ACTION should expect to be fired ! Example: Say your boss wants you to work a sunday. You file a restraining order…..BINGO- he fires you for cause.
You guys hoping Leach gets millions and takes Tech down and out….I thought you were supporters of Tech ? Forget his wins or YOUR opinion of if this kid deserved this punishment…..LEACH FAILED TO DO WHAT HIS BOSSES REQUESTED. THATS INSUBORDINATION because what they requested was within the law (and reasonable).
Leach’s defense seems to be ALL about OTHER THINGS and in the alternative…he didnt do it. The truth is likely he did and certainly that he didnt cooperate with his bosses. Hate James and Meyers et al ALL YOU WANT but please quit trying to defend Leach’s insanity….and QUIT TRYING TO HURT TEXAS TECH !!

LAST TIME/ THE FACTS
1) Tech believes Leach was mistreating a player.
2) Leach may believe that isolating an injured player (concussion is good medical treatment) or that this was reasonable punishment
3) Tech attempted to resolve the dispute with the parent and requested Leach’s cooperation. Leach refused.
4) Tech suspended Leach with pay, thus no back pay is due, while investigating this issue
5) Leach filed a restraining suit against Tech to prohibit them suspending him.
6) Tech believes all the above to be insubordination.
7) The contract had time tables. Leach was fired PRIOR TO the date required to receive that 800,000. ALL disputes occurred PRIOR TO that date as well.
8) An employer has the right to fire an employee. Since in this case theres a contract…..the ONLY issue is was there cause to terminate the contract. TECH HAS BEEN DAMAGED IN THE MILLIONS FROM THIS BAD PUBLICITY as a direct result of an employee not following instructions and then attempting to have a court prohibit them from suspending an employee.
If Meyers and the administration had INSISTED that James play every down….then as an employee Leach would have had to follow their direction or find himself charged with INSUBORDINATION. Matters NOT if that would have been good advise ! It matters ONLY if what they were requesting was LEGAL, and this contract to not punish in this manner ever again IS a legal request. I promise you Leach isnt such a smart legal guy or he would never have made these stupid moves !

Leach did not damage TECH – TECH damaged TECH by the way this was handled.
A players father goes over the Coach’s head complains to his boss and the Chancellor. All TECH had to do at that point is say I am sorry to here this, we are going to look into, and if we find any wrong doing we will correct it, so this never happens again. We will get back to you and let you know our findings, what actions we will take and procedures we are going to put in place. I am sure any Father would have been satisfied with that response. Leach could have Coached the Bowl, TTU could have finish the investigation and then take appropriation actions and saved this great University and players a lot of embarrassment. I am sure that is how UT, OU, Penn St, ND etc and other great schools would have handled it. It could have been handled in a professional matter, instead of pointing fingers, throwing people under the bus, pitting coaches and against coaches all in the National Spot light. I am trying to remember when another University Chancellor when on ESPN (ESPN for goodness sake) and talked about a University’s internal problem. Again, I don’t think UT, OU and others would have handle this issue like this. Tech looks so not big league, so not professional (so small with the he said she said thing), Nationally the University took ten steps back. PR 101 perception is reality!

I would have done EXACTLY what Tech did….in the beginning. I would have demanded Leach return to Tech to discuss this matter before it became public. If that meeting we couldnt come to an agreement I would have requested him to resign. If he didnt I would have fired him. Now I would disclose EVERYTHING thats gone on since he has been at Tech including some things that surely would turn public opinion against him.
I would stress its NOT that this treatment did not damage this kid. ITS that it was UNFAIR, Put the kid at greater risk, AND DAMAGES TEXAS TECH’S REPUTATION ! As for Leach not cooperating or following instructions….I would point out that THIS alone wont be tolerated by TECH from ANY department and that it NEVER HAS !
I havent heard a single good reason supporting THE EMPLOYEE for not following his directives, since there were legal. Maybe Leach didnt do anything more than agree with the trainers to put this kid “somewhere’ thats dark, but THEN not doing what the bosses say is grounds for getting your butt fired ! Thats my opinion and the reasons for it.

booster32 – Apparently we disagree. And I now disagree with you even more than I did after your initial post. Take a corporate management course and/or attend a human resources seminar and you will know you are off base on most of your additional points. Labor laws are in place to protect the employee who is told by his employeer to do unethical things, such as sign untrue documents. As an example, if a bookkeeper is told by his/her employer to falsify the books, the bookkeeper is held just as responsible as the employeer. Give the IRS a call to verify. If these laws were not in place you would not only have to work on Sunday, but you would not get paid.
I have no problem in agreeing to disagree with you, but I do have to take issue with your statement “QUIT TRYING TO HURT TEXAS TECH.” I love TTU at least as much as you. In my opinion Leach has been wronged. This is my opinion and you are welcome to disagree. I am more than willing for the legal system to do its work and if when it is all over we find out that Leach, and the James’, and Myers, and Hance and Sowell, and any others are all lying then I would hope they all are declared cancers and released from this school and never allowed to be within 50 miles of any TTU campus. I am NOT trying to hurt Texas Tech. I, like you, am just expressing my opinion. I have that right. I learned that at TTU. I also have been quoting from published articles and filed documents. Check my posts. When I do put in my opinion, it is expressed as my opinion, subject to conjecture and error. I may error, but I am not hurting my school like I believe the administration is doing.

The cop expresses he disagrees. Tech then requests he sign an agreement to never do this again. The cop refuses ! He is suspended with pay while an investigation is being conducted. The cop files a restraining order attempting to stop the suspension…..Tech then counters by firing him.
“GOOD PEOPLE” cant make decisions for an institution ALONE or that opposes management’s directives. booster32 – From my understanding they told Leach to sign an apology and then they told him to sign a “How to deal with an injured student” document. IF – and I leave that open to interpretation – he did nothing wrong, why should he admit to the need to apologize. He was standing up for his reputation. IF he was told to sign a “How To” document that no one else on campus had to sign, then it was just a cover to put a poor review document in his file, something to be used to fire him. Large corporations do this all the time.
My view on the funds hold-backs is to put your donations in an escrow and when this issue is settled then give it. This will vary from person to person due to what they feel is an acceptable settlement. My donations, memberships and other financial involvements are on hold, not cancelled. Presently I feel I want Myers and Hance replaced to get my funds. I believe Leach is gone and no matter what is revealed he will not be back. BUT – should there be other issues come out; or Myers retires and Hance admits to mishandling this (my opinion) situation, then maybe they get it sooner.
My feeling is that even if Leach is 100% wrong, Hance and Myers handled this poorly. The USF coach fired today “hit a player twice in November”. The output of the investigation just came out today after they played their bowl. The school comes across much more professional. Even if they had to pay Levett a bonus of say $800K to coach that bowl, it is going to cost them a lot less than Tech has to pay even if they are proved right.

booster32 – What the administration at Tech has done is allowed for every whiny player who doesn’t get his/her way to make a complaint against the coach. You obviously know nothing about sports or the way that a sports team is operated. Coaches are not there to be mamas and daddys. They are there to win ball games and sometimes they have to be hard on players to get that done. On every team there are those players who think they deserve special treatment for one reason or another…because of who their parents are, etc. What’s not fair? That these players draw so much attention to themselves with their whining and expectations of special treatment that other players are forgotten.
Adam James is an adult. He needs to grow up and act like one! His “daddy” won’t be around forever. If he truly felt he was mistreated, he should have handled it like a man…on his own. He should have left his “daddy” and ESPN out of it!

You cannot fire an employee because they sued you. You can, within reason, make their life miserable so they will quit. The question would be why you still wanted to work somewhere you had to sue. If a company could fire someone due to legal action then it would eliminate the legal option to solve a problem. i.e. If a company refuses to pay money earned by a hourly worker and he has no option to collect it but quit his job, then sue the company, where is the justice? He wins the case, collects $500 and is unemployed. Reality is the company cannot fire the worker, they have to pay the money he is owed and then they begin to plan on a legal was to fire him anyway. The worker, if he can find a job now-a-days, is better off at a different job than work for someone who mistreats you.

These blogs are not productive nor informative. Lets see what a court says meanwhile I am for Tech and not rooting for Leach do further damage Tech. Do you believe what you are doing is helping Tech ? The law supports Tech’s position but people like some of you seem to only believe that Leach had a right to do whatever he wanted as Tech’s coach. EVEN LEACH hasnt filed a complaint for wrongful termination ! He knows thats a loser !! His complaint is that under that contract they couldnt terminate him or in the alternative their reason for cause doesnt satisfy that clause. When your boss next tells you to do something that you arent in favor of try pulling a LEACH and see what happens to you. The term for that is INSUBORDINATION ! The guys paying your salary maintain the right to give directives. Imagine if an ast coach had gone against a Leach directive. Would he have that right as well, or would Leach have the right to terminate him with CAUSE ?
Bottomline to me AFTER the dispute w/ James : Was Leach following the directives of the board or was he insubordinate by not doing what was requested of him. IT APPEARS HE IGNORED THE BOARDS DIRECTIVES !! You guys keep saying James should have simply quit if HE didnt like Leach’s directives. Maybe Leach should have quit if he didnt like the board’s directives. He is a big boy too, right ? Some you are the ones wanting Potts to quit etc. , and then were cheering him on the very next week. I also believe that Hance has to go for the sake of the school not just Leach. I do not think that even if all these things happened Mike would come back. Not because he doesn’t love Tech, but because of such a bad taste this situation has left with him and the major step backwards this situation has caused the football program. Leach’s apparent willingness to leave in previous years was caused by Myers, not any unloyalty to the program.

If part of your job description is to make coffee every morning, then you need to answer to your boss if you did not do it.
If it is not part of your job description then your boss should request you make coffee but not demand it. If your boss demands you write an untrue email to make it sound like another employee is guilty of something they did not do, or to make them sound not guilty of something they did, you will be just as guilty in court as your boss if you agree to do it and get caught. How do you protect yourself from a boss who would put you in such a position? Of couse he/she will tell you are not being part of the team. Golfwoody,
You sound sincere. Do you really believe that the Board asked Leach to sign anything that was a lie ? All these men are would be criminals ? Dont you think ONE from all these men, including Leach, could have satisfied this issue by agreeing that no student athlete would be isolated in a shed ever again ? This does no admit guilt from previous events does it ? I understand Leach to say he did NOT make these orders. If thats true, he simply could have insisted that such a statement was included on that agreement;
I, Mike Leach, have never ordered etc etc and will never in the future order etc etc…..
If Tech thought the trainer to have been the ONE that ordered Leach into that shed I would think he would have been the one to be terminated, right ? What should Tech do if in the future a trainer orders a kid to stay in that shed for a few hours ….inspite of their objections to this type of treatment ? Do you SINCERELY believe that trainer, in this event ,would be within jis rights to say…and do what Leach has done ?
I FULLY understand the poor relationships that Leach had with many at Tech and that some are very happy to see him leave. Thats not at issue here. What is at issue it seems is “CAUSE” and if cause terminates the contract if if occurs BEFORE the bonus was due, and if Leach legally is entitled to collect AFTER the termination/cause for the balance of his contract. If anyone believes that Leach should be paid even if there was cause for termination than……that contract could not be terminated PERIOD, thus why put a termination clause in it ?
Again, what exactly do you think was wrong with asking Leach from refraining from treating players like this ? I dont see that as asking him to ‘blame’ others.

booster32, the argument here is simply about like and hate. we like Coach Mike Leach. We hate whiny, wussie boy adam james, we hate his dishonest, lying father, craig james. we hate kent hance. we hate guy bailey. we despise gerald meyers and we dont like people like you. Everyone is picking their sides, you chose yours and we chose ours. I wouldnt do what those incapable morons told me to do either. Did someone place you in a dark closet and you wet yourself? The problem here is not just meyers and Leach, its meyers and sharp, meyers and hayes, meyers and knight. and so forth. See the common denominator? I would love to have Mike Leach back but, i wouldnt care who the next coach is as long as meyers and his clowns are gone.

Sally,
The cause is documented by the trainers statements. Leach didnt deny this in the beginning….now I suppose his position is “I didnt know” where THEY took James, etc.
I read quotes saying if “If I didnt say that I wish that I had “…..thats not a strong denial.
You guys are stuck on thinking that “agreement” was one which would have been admitting “guilt”. My understanding is that it was a statement agreeing it would not be an acceptable practice in the future.
Its really simple: FOLLOW OUR ORDERS, EMPLOYEE. The employee may be ‘right’, but if he doesnt follow the directives he is being insubordinate. Its ideal to own your own business (team), but Leach didnt.
Why dont you guys take up a collection in an attempt to raise 12 million to settle this suit for Leach ? If each of you 54,000 would contribute just 225.00 —– its over !

Bernie,
You are at least honest. The facts dont matter to you. You like Leach and hate Meyers. So try to petition that Meyers be fired. I understand that. Trying to punish Tech with a 12 million pay off HURTS TECH ..ALOT !! Do you “like’ that, or hate that ?

Sorry, for the possible disjointed entry, but the moderation filter attacked me again. Here is the first part of my posting: (hope it makes it through)
booster32,
First let me say, I do not hate you. I think that was an out of line statement by another in this blog. I do not agree with you but I do not hate my fellow Texas Tech Supports. We may not agree on the direction we need to take, but there is no reason to hate each other.

Okay, first part made it through. I’ll try some more.
I do not believe Myers asked Leach to lie, but I do believe he is capable of asking him to make this problem go away by saying he is sorry to something he is not and should not be sorry for. End result, if he did apologize, it would be untrue, a lie. I do believe that, asuming Hance was involved in the document on “How To Handle an Injured Player,” he fell into his “it depends on what your definition of “is” is” poltical stand. I can VERY easily see him saying, “Just sign it and everything will be okay. You don’t really think you would get fired because of this do you?” That sounds an awful lot like how Satan tricked Adam and Eve. Based on the emails from last February, anything Sowell says would bring his ethics in question. I don’t believe all the Regents are dishonest, but I do question some of their intentions. I believe an independent, out of state group should investigate them.

This moderation thing is a joke. I eliminated one “s” in as(s)uming and it went through.

Here’s my question (primarily for booster32 though anyone can answer):
Egos aside (which makes this somewhat rhetorical, I know, as it certainly appears this entire event was a conflict of egos on all sides), why do you think the Tech administration would not let the restraining order go before the judge if they thought they were in the right? Could it be that the Administration was afraid that Coach Leach had legal basis to repeal the suspension … and that was an $800,000 risk they weren’t willing to take?
So, by rushing to fire Coach Leach without providing even an appearance of the 10-day due process provided for in his contract, the Administration was given a black eye … but had they allowed their suspension to be overturned they would also look like idiots. The old “cornered rats” scenario ….
What a victory by Coach Leach in the courts will do is identify the specific personalities that are the cancer to TTU. The University as an institution will come out just fine in my opinion.
The one major unknown in my mind is the actual start of the timeline that the Administration informed Coach Leach of their intention to terminate his employment. If the initial date was December 21st or earlier, a firing on the 31st might have been within their rights. Any time after the 21st, however, and I think they’re due to be taken behind the proverbial shed when the case goes to trial.

32 ,Yes as long as the peoplethat started this fiasco, I have stated many times, Iam a Tech FAN and as ong as these people are inn charge and dont want to take resposibility for destroying a program that had a winning record, high graduation rate,, wheter you agree or not Leach ha s done a lot for this program and has gone to 10 bowl games, he gave people here in Lubbock hope and pride, he was able to take cast off playersthat noone really wanted, example, W es Welker and Joe Filani and Eric Morris and a host of others and make stars out of them, And Danny Armedola ,to boot,Coaches Like him come along once in a lifetime, He was railroaded, pure and simple , if people didnt think that way why would they stil be mad, corruption and greed, right and wrong, integrity and honor and loyalty, Ihave been a Tech Fan since Dewitt Weaver and have been a FAN through the good times and bad, ive been around and I do know the score and this mess is unprecedented, it is insane to the 9th. degree, ther is really no way to describe this fiasco and then you ask if Im a Red Raider , iam and will always be but there are times that you have to speak out and make a statement, Like Zach, and I will stand behind him and anyone else until these incompetents are gone..

Landing at Lbb;
I think you are right in your first paragraph scenario.
The Tech gang of 3 hadn’t had time to properly twist the arms of the affidavit people to include their own opinion on the facts they recited.
The trainer & doc were pro-leach to begin with, until the “signed & dated dec. 30th” ones were secured. And until Leach himself started saying things like – “I didn’t know where they had taken him except out of the light”.

I’m not sure what the purpose of “Team Leach” is, but you’ve got to know that Mike Leach will never return as the TTU football coach. At this point all he wants is money.
And I think any intentions you may have of ousting members of the administration and dragging this thing out will only hurt Tech in the long run. It’s like you are cutting off your nose to spite your face.
“You fired my favorite coach, so I’m going to make sure the University suffers for it.”
Real smart.

Jayess,
Not the case. We want ‘right’ to win out. It is my personal belief that Leach will not return no matter what, but I strongly believe the TTU leadership very badly mishandled this whole situation. Please read thorugh the 245 or so posts on this blog and you will get an idea of the variety of views pertaining to this situation.
